Terms of Service

These Terms of Service (“Terms”) are an agreement between you and FastKesh Technologies Ltd. (“FastKesh”, “we”, “us”, or “our”). They govern access to our websites, dashboards, APIs, SDKs, and payment products (the “Services”).

By creating an account, submitting an onboarding request, or using the Services, you agree to these Terms. If you are using the Services on behalf of a company, you represent that you have authority to bind that company. If you do not agree, do not use the Services.

Services covered and Limitations

FastKesh provides payment infrastructure that lets businesses accept, send, and reconcile money across cards, local methods, payouts, and related tools. Features may include checkout, payments APIs, payouts, risk screening, reporting, and developer resources.

The Services are provided as a technology platform. FastKesh is not a bank, and we do not provide legal, tax, or investment advice. Availability of methods, currencies, and settlement times depends on your country, partners, and applicable rules.

We may modify, suspend, or discontinue features with reasonable notice where practicable. We do not guarantee that the Services will be uninterrupted or error-free.

Eligibility

To use the Services, you must:

  • Be at least 18 years old and able to enter a binding contract
  • Operate a lawful business that is permitted to use payment services in your jurisdiction
  • Not be prohibited from using the Services under applicable sanctions or other laws
  • Complete onboarding and provide information we reasonably request

Account Registration

When you register or request access, you agree to:

  • Provide accurate, current, and complete information and keep it updated
  • Keep credentials, API keys, and access tokens confidential
  • Notify us promptly of unauthorized access or other security incidents
  • Accept responsibility for activity that occurs under your account

We may refuse, suspend, or close an account if information is incomplete, misleading, or if we believe the account poses legal, fraud, or credit risk.

User Responsibilities

You agree to:

  • Use the Services only for lawful purposes and in line with these Terms, card-scheme rules, and local law
  • Not reverse engineer, overload, or interfere with the platform or other users
  • Not attempt unauthorized access to systems, data, or accounts
  • Not submit prohibited, fraudulent, or misrepresented transactions
  • Display required checkout disclosures and handle customer complaints in good faith

Intellectual Property Rights

FastKesh and its licensors own the Services, including software, documentation, logos, and related content. These Terms do not transfer ownership to you. You receive a limited, non-exclusive, non-transferable right to use the Services for your internal business while your account remains in good standing.

You may not copy, sell, sublicense, or create derivative works from our materials except as expressly allowed in documentation or a written agreement with us.

Data Privacy and Security

How we collect and use personal information is described in our Privacy Policy, which is incorporated into these Terms.

We apply commercially reasonable security measures. You remain responsible for securing your systems, customer data you control, and any integration you build on FastKesh.

Payment Terms

Fees, reserves, rolling holds, and settlement timing are set in your pricing schedule, dashboard, or a separate commercial agreement. You authorize FastKesh and our partners to process charges, offsets, and chargebacks related to your activity.

  • Fees may be quoted in USD or another agreed currency
  • You are responsible for taxes that apply to your use of the Services
  • Unpaid amounts may result in suspension or set-off against settlements

Policy and Fees

Applicable fees are shown before you process live volume or as otherwise agreed in writing. We do not add undisclosed platform markups beyond what is disclosed to you.

We may update fees with prior notice. Continued processing after the notice period constitutes acceptance. Refunds, if any, follow your commercial agreement and scheme rules.

Licensing and Permitted Use

If you use our APIs, SDKs, or hosted checkout, you agree to:

  • Follow published documentation, authentication, and rate limits
  • Protect API keys and rotate them if they are compromised
  • Not scrape, resell, or misuse the APIs in a way that degrades the Services
  • Accept that we may change endpoints with notice as described in our developer docs

Termination of Services

You may stop using the Services at any time. We may suspend or terminate access immediately if you breach these Terms, present elevated risk, or if we are required to do so by a partner or regulator.

Upon termination:

  • Your right to use the Services ends
  • Outstanding fees, chargebacks, and reserves remain payable
  • We may retain records as required by law
  • You may request an export of eligible data within 30 days, subject to compliance limits

Confidentiality

Each party may receive non-public business, technical, or customer information from the other. The receiving party will use that information only to perform under these Terms and will not disclose it except to personnel and vendors who need it and are bound to protect it, or as required by law.

Indemnification

You will defend and indemnify FastKesh, its officers, employees, and affiliates against claims, losses, and reasonable costs arising from:

  • Your use of the Services or your customer transactions
  • Your breach of these Terms or applicable law
  • Your infringement of a third party’s rights
  • Content or data you submit through the Services

Liability Limitations

To the fullest extent permitted by law, FastKesh is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill.

Our aggregate liability for claims relating to the Services is limited to the fees you paid us for the Services in the twelve (12) months before the claim. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

Intellectual Property Infringement

If you believe the Services infringe your intellectual property, send a notice to the contact below with enough detail for us to investigate. If we believe a claim may affect the Services, we may modify the feature, procure a license, or suspend the affected part.

You must not use FastKesh marks in a way that suggests sponsorship unless we give written permission.

Modifications

We may update these Terms by posting a new version on this page and changing the effective date. Material changes may also be sent by email or shown in the dashboard. Continued use after the update is acceptance of the new Terms. If you do not agree, you must stop using the Services.

Miscellaneous

These Terms, together with the Privacy Policy and any order form or pricing schedule, are the entire agreement for the Services and replace prior discussions on the same subject.

They are governed by the laws of Singapore, without regard to conflict-of-law rules. Courts in Singapore have exclusive jurisdiction, except that we may seek injunctive relief in any venue. If a provision is unenforceable, the rest remains in effect. A waiver on one occasion is not a continuing waiver.

You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Third-party networks and processors are independent parties; we are not responsible for their independent acts.
